Online Symposium at CTLab

Next week CTLab in it’s slick, officially rolled-out, version kicks off it’s new iteration by hosting an online symposium on the Hamdan trial ( note, this is not the SCOTUS decision in Hamdan v. Rumsfeld – though I’m certain that case is also fair game for discussion –  but instead Hamdan’s subsequent trial by military tribunal).

Dr. Williams has drafted an original, narrative account of his experience, and is making it available for discussion through the CTlab weblog. It will be released for public consumption, followed by comments and observations from a panel of invited legal scholars and social scientists based in the United States, the United Kingdom, Canada, Australia, and New Zealand.”

I’ll put in my two cents regarding the symposium and Hamdan after the conclusion.

Kosovo Rising

A new nation declared itself today after close to a decade as a UN protectorate; a fragment of a fragment of an extinguished artificial state once built upon the polyglot ruins of European empires and Muslim sultanates. This particular geographic node, Kosovo, has a quality that all of it’s larger forerunners lacked – the cultural unity of identity that will make the nation the primary loyalty of the overwhelming majority of it’s citizens. A fact on the ground that trumps diplomatic protests over the finer points of international law or the mythic appeal of seven hundred year old Lost Causes.

Kosovo’s declaration of independence is ultimately rooted in an overwhelming demographic reality that could have only been altered by Kosovar Serbians having had larger families three and four decades ago than their poorer Albanian neighbors; and the Yugoslavian and Serbian governments having given rural Serbs some kind of economic incentive not to migrate to Belgrade or the larger towns of Serbia proper. As such, Kosovo’s declaration is worrisome to all multiethnic states plagued by separatism where the majority population is in decline – from the windows of the Kremlin, Serbia today must look hauntingly like Russia writ small.

However demographics alone was probably not enough here to explain Kosovo – Kurds, Shan, Tamils, Basques, Tibetans, Palestinians, Uighurs, Baluchis, Pushtuns and in previous centuries, the Irish – all thoroughly dominate their respective homelands but are not yet being welcomed into independence by great powers. What hapened is that the adversaries of the Kosovar Albanian, the Serbians nationalists, also morally de-legitimized themselves under Slobodan Milosevic, with years of atrocities and ethnic cleansing in Croatia and Bosnia-Herzegovina. Milosevic and his murderous policies had considerable popular support until the very end; they still retain support from a not inconsiderable, defiant, hardcore as evidenced by the inability or unwillingness of Serbia to bring Radovan Karadzic and Ratko Mladic to justice. As the Germans bade farewell forever to East Prussia and Silesia in 1945, Serbians today can reflect on Sarajevo’s impact upon their legal claim to sovereignty over Kosovo.

That being said, events can be handled well or poorly. Kosovar independence would have gone down better in a world where Russia was a prosperous, democratic state, thoroughly integrated into the Core and a regional strategic partner of the United States instead of a bitter, increasingly paranoid, plebiscitary “soft” dictatorship that views America with grave suspicion and the EU with contempt.  That was not an outcome that Washington could have created alone but a relationship that three administrations might have attempted to build with Russia but elected not to do so. Benign neglect mixed with pressure toward Moscow was a deliberate choice on our part, one that might have made Berlin, London and Paris happy in the 1990’s but it wasn’t to our long term strategic benefit.

Independence is good for the Kosovars and in the last analysis, inevitable; but our statesmen should be arranging matters so that the United States profits from inevitable events rather than simply bearing the diplomatic costs.

WANTED! FOR CRIMES AGAINST HUMANITY

Than Shwe and all members of the instrumentalities under his authority as commander-in-chief and Chairman of the State Peace and Development Council, are accused of crimes including, but not limited to, actions defined under Article II. and Article II. of The Convention on the Prevention and Punishment of the Crime of Genocide:

“Article II: In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

(a) Killing members of the group;(b) Causing serious bodily or mental harm to members of the group;(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;(d) Imposing measures intended to prevent births within the group;(e) Forcibly transferring children of the group to another group.

Article III: The following acts shall be punishable:

(a) Genocide;(b) Conspiracy to commit genocide;(c) Direct and public incitement to commit genocide;(d) Attempt to commit genocide;(e) Complicity in genocide. “

The mass and systemic suppression and extrajudicial murder of Buddhist monks and ongoing ethnic cleansing campaigns against the Karen minority qualify for a referral to the UNSC for the establishment of an international tribunal to investigate, indict and try Burmese leaders suspected of crimes against humanity and genocide.

A LEGITIMATE QUESTION: 4GW AND POLITICAL LEGITIMACY

The enigmatic M-1 of the lively IO/PSYOPS blog Swedish Meatballs Confidential graced the comment section of the previous post and posed an excellent question:

“Q: Can there per definition exist legitimate* 4GW entities? If so, could you please, at your convenience,name any number of them.”

I can attest, from some years of studying diplomatic history, that “Legitimacy” in international relations is a lot like obscenity – hard to define but everybody knows it when they see it. The problem is that scholars, diplomats, jurists and intellectuals tend to see legitimacy most clearly when it happens to accord with their own interests.

For example, Neo-Realist IR theorists, Islamists, Marxist-Leninists, Burkean Conservatives, Lockean classical liberals and Liberal Internationalists will all construct arguments that appeal to the legitimacy, or argue the lack thereof, in certain regimes or institutions. Their premises differ as to the origin of legitimacy but the concept itself is regarded as sound across a wide political spectrum – excepting perhaps the fringe of Gramiscian -postmodernist-deconstructionistic radicals, whose tireless efforts to de-legitimize and dismiss nearly everything in the Western intellectual tradition only emphasizes the importance they really attach to legitimacy (At this point, I’d like to invite Dr. Daniel Nexon of The Duck of Minerva to add anything on academic perceptions of legitimacy, disagree with me or generally put in his well-informed two cents).

That being said, as average people are not afflicted with the abstruse theories of intellectuals, I think the Lockean concept of “consent of the governed” is most useful here in addressing M-1’s question. Most people stuck in a conflict zone are going to be pragmatists, interested in the restoration of peace on the best terms possible for themselves. It is for their affinity that the 4GW game is played.

Consent does not require democratic elections. Elections make popular consent visible, quantified and, where society operates under the rule of law, elections are a regular, contractual, but temporary grant of authority from the people to their government. Authority can also be granted implicitly by consensual, popular, deference as with homage given to Shiite maarjas, the King of Thailand, the Pope, the Emperor of Japan and the Supreme Court of the United States, whose powerful judicial role is formidibly augmented by the widespread acceptance of it’s moral authority as the legitimate arbiter of the meaning of the Constitution.

4GW entities, like states, can acquire ( and lose) moral authority and thus, political legitimacy, through their actions. We may not find this to be logical or objectively factual when Hezbollah or al Qaida are measured against a theoretical ideal. That however, is irrelevant to most the audience in the conflict zone. What matters is what you are measuring the 4GW entity against in the real world. A corrupt, incompetent, oligarchy? A vibrant, prosperous, liberal democracy? A constitutional monarchy backed by long tradition? A Communist regime? A hated dictator ? A foreign army? What ?

Much like time, legitimacy is entirely relative. The people might yearn for steak but if one side is providing nothing but crumbs and the other promises chicken – and can come across with a drumstick now and again – the side with the chicken wins.

YOU CAN BLEED THEM WHILE YOU NEGOTIATE WITH THEM

When Robert Gates, the current Secretary of Defense, retired from government service after the end of the first Bush administration, he wrote a memoir , From the Shadows, in which he described the no-nonsense, George Schultz as ” the toughest Secretary of State I ever knew” who ” saw no contradiction” in bleeding the Soviets in one part of the world while negotiating with them in another. Secretary Schultz, whose opinion of the CIA on a 1 to 10 scale hovered in the negative integers, was not nearly as complimentary to Robert Gates in his own, ponderously unreadable, memoirs, but that is a story for another day.

I bring this anecdote of a less complex era up because of the furor over the Bush administration classifying the Pasdaran ( the Iranian Revolutionary Guards Corps) as a terrorist organization in order to take action against those business enterprises that are connected to the Pasdaran. The objections to this move appear to be two-fold: first, that it hypothetically puts American military personnel at risk of maltreatment and, secondly, that it could disrupt negotiations with Iran on a range of bilateral and international issues, most importantly, Iraq.

The critics are incorrect. It is a move a quarter-century overdue.

In the first instance, correctly identifying the Pasdaran as a state sponsor of international terrorism, which as a matter of historical record, it clearly is, does not prevent treating it’s uniformed personnel as POWs in case of an armed conflict between Iran and the United States. The Pasdaran, by contrast, has already tortured two Americans to death – Beirut CIA station chief William Buckley and USMC Colonel William Higgins – at a time of peace between Iran and the United States.

Cry me no river of tears for Pasdaran agents in Iraq being held captive by the U.S. military or who are being whacked in some alleyway by Sunni tribals in our employ. The Iranians knew the risks, from the inception, of the rules they chose to operate under, violating the most basic precepts of international law. It did not have to be that way – even the CIA and the KGB came to a rough modus vivendi during the Cold War that prevented most escalatory incidents – Teheran though has chosen to play rough. Let them enjoy the bed they have made for themselves.

Secondly, until we have an agreement with Iran we do not have any agreement and the regime should be squeezed at every point until we do. I’m all for negotiating in earnest, making the realistic, even generous, concessions that we can easily afford, finding areas of common interest and ( eventually) normalizing relations. We should scrupulously keep our word and demonstrate to the Iranians through actions that we will deliver exactly what we promise. But until that point in time, Teheran should get no favors, no breathing space, no economic freebies of any kind until we come to an arrangement.

The leadership of Iran is a nasty and brutal group. Within that circle, Ahmadinejad represents some of the regime’s worst elements but, as a whole, the Iranians do not seem irrational, simply adversarial. We can cut a deal with them but we should proceed without any illusions.
