THERE’S A FINE LINE BETWEEN AN ACT OF PIRACY AND JUST SIMPLY TAKING SOME INITIATIVE

A fascinating economics paper sent to me by Fabius Maximus (hat tip accorded) that took me a few days to get to reading. Wish I had looked at it earlier:

An-arrgh-chy: The Law and economics of Pirate Organizations” (PDF) by Dr. Peter T. Leeson

Peterson argues that historical pirates, far from being Hobbesian outlaws, governed themselves with rule-sets that minimized conflict and maximized cooperation and profit ( albeit at the expense of civilized seafaring states). Looking at broad principles of functionality, Leeson’s work is applicable to other violent non-state actors – Latin American drug cartels, 4GW insurgencies and terror networks, warlord and sectarian militias, Bunker’s 3 Gen gangs, TOC groups like Chinese Triads and Russian mafiya and so on.

This argument struck a chord with me on two points. First, it mirrors the historical experience of traditional Russian banditry where robber chieftains ruled over there fellows according to “Thieves Law”, something Solzhenitsyn discusses at length in The Gulag Archipelago.

Secondly, network theory research indicates that small systems that seem chaotic or “noisy” actually develop emergent rule-sets that bring the system into an orderly pattern, even if the rules and patterns are very simple ones. A pirate ship, even a fleet, much like a terrorist network, is simply a small, complex, social network. Rules accepted on a consensual basis cut down on ” noise” and allow the network to become more efficient.

FABIUS MAXIMUS ON THE GENERALS

Fabius Maximus critiques American generalship in his trademark style:

The Core Competence of America’s Military LeadersThird in a series about a serious threat to America

There’s a number of provocative arguments in FM’s latest piece but I wanted to highlight this one in particular:

“The events surrounding the fall of Iraq’s capital are difficult to imagine, even after four years have passed. US forces again proved invincible on the field of battle. They rolled up to Baghdad, occupied it and waited for orders. Then the capitol fell into disorder, with looting and burning of key infrastructure.

Apparently the Pentagon’s senior generals – the best-educated generals ever to lead an Army – failed to prepare for one of history’s most common scenarios. As a result they read reports from their field commanders and watched as victory tipped over to what might become a crushing defeat. Perhaps for the next war our top generals’ briefing books should include DVD’s of War and Peace and Gone with the Wind. Watching the burning of Moscow and Atlanta might remind them to plan for this contingency.

It’s not yet clear why and how this occurred, except in one respect. Our military is a full member of 21st Century American society – no separate military culture here – and its top leaders produce excuses suitable for a Superpower, featuring the new American mantra: “It’s not our fault.” An expert at RAND said it well:

While it can be argued that U.S. military planners could not have been expected to anticipate the emergence of an insurgency any more than they could have foreseen the widespread disorders, looting, and random violence that followed the fall of Baghdad, that is precisely the nub of the problem. The fact that military planners apparently didn’t consider the possibility that sustained and organized resistance could gather momentum and transform itself into an insurgency reflects a pathology that has long affected governments and militaries everywhere…

RAND’s sponsors likely appreciated the diplomatic phrasing “while it can be argued”. Much nicer than suggesting that our generals should have foreseen the scenario that has dominated post-WW-II wars, guerrilla warfare against foreign occupiers.”

In the article, FM refers to American generals as being akin to corporate CEO’s. The personnel system of the U.S. military, in which zero defects and lavish ( bordering upon ludicrous) praise from your immediate superior is necessary for promotion under an “up or out” system, weeds out creative and divergent thinkers, candid speakers, risk-takers and even mild non-conformists. What is left is a finely honed and homogenous administrative class attuned to institutional norms and a received professional culture. A system that creates a surplus of first-rate political generals like Al Haig and Colin Powell but not Pattons, Grants or Lees. A few slip through, but how many ? And of these few, how many will have a chance at field command ?

Incentives must be geared to promote those who exhibit behaviors that tend to win wars on the battlefield rather than bureaucratic skirmishes in Washington.

IS THE INSURGENCY OVER?

Fabius Maximus offers a contrarian argument at DNI -” The Iraq insurgency has ended, which opens a path to peace“. I found this to be one of FM’s most interesting pieces, which should be read in full; I will comment on several points that intrigued me in particular:

Having a bureaucracy, capital, constitution, and seat at the UN does not make a government. Governments have specific characteristics. The more of these they possess, the stronger and more durable they are. The most important attributes:

Control of armed forces, or even monopoly of armed force in its borders.

The ability to levy and collect taxes.

An administrative mechanism to execute its policies.

Territory in which it is the dominant political entity.

Control of borders.

Legitimacy (not love) in the eyes of its people.

The national “government” of Iraq has, by most reports, none of these. It lives on oil revenue and US funding. Its ministries are controlled by ethnic and religious groups, parceled out as patronage and run for their “owners” benefit. The only territory it controls is the Green Zone, by the grace of the Coalition’s armed forces.”

Defining or determining the “legitimacy” of states is one of the stickiest questions in international relations and one in which statesmen, political scientists, historians and international law experts lack a consensus. De jure recognition of other states is a small substantive component but a large diplomatic one and it can matter. Having the consent of the governed, implicitly by primary loyalty or explicitly through an electoral process is critical but it can quickly be frittered away through incompetence and weakness.

What were the Iraq elections? An expression of hope by its people, or an ignorant or delusional attempt at nation-building by America. Perhaps both.

Either way, it was a step on a path to nowhere. Athenian democracy and the Roman republic were built on a foundation of internal political machinery by which the leaders’ decisions were translated into actions. Iraq lacked that after our invasion, and we constructed the government with no supporting bureaucratic mechanisms. Voting does not magically call the necessary apparatus into existence.

The only effective political apparatus in Iraq exists at the local level. Much of that is done by the most basic form of government: only those commanding armed men have a vote.”

The democratic vote in Iraq was a historically important moment, Fabius underestimates the import. He is however, quite correct, that the moment was not capitalized upon nor did the administration even attempt to prepare the interim Iraqi government to do so. Most of the political momentum was lost and democracy as a value was depreciated in the long and mostly pointless wrangling among Iraqi parties that followed. Where was General Leonard Wood when we needed him ?

Fabius also offers some advice:

“Beyond that, there are two possible ways we can help.

First, to secure public spaces in Iraq’s major cities – a form of static defense. No longer attackers, clear to all as only temporary helpers, we might transform from targets to neutral guardians.

Second, even more important, we can secure Iraq’s borders, especially with Iran. Iraq has no Army, probably by our design to maximize their dependence on us. In this role we can relocate our forces out of harm’s way (except as needed as above). Unlike the dreams of neocons, this is probably not a long-term arrangement. If Iraq survives, eventually it will build a real army and tell us to leave.

This plan gives us a soft exit path, no matter what happens in Iraq.”

Some of this is quite sage but I’m hard pressed to see how the first part in particular is going to be different in the functional military sense from what General Petraeus is doing with the COIN surge. Different intent on FM’s part, certainly, but actions will be similar, if not identical.
