Frequent commenter Schmedlap, who has a fine blog of his own, asked his readers a very important question:
Today a smart, well-traveled, experienced, knowledgeable guy was telling me that “rule of law” is a concept that we need to stop worrying about. Strongly disagreeing, I asked why. After he explained why, it became clear that he was working with a significantly different definition of “rule of law” than I knew of. It reminded me of recent discussions here and elsewhere over definitions of culture, torture, and terrorism. Given his definition of “rule of law” I agreed that it is not something that we need to worry about. If “rule of law” = his definition, then rule of law is not important. If “rule of law” = my definition, then rule of law is important.
Just curious, what is your understanding of what “rule of law” means?
I attempted to leave a comment, using a Google Chrome browser, but it failed to “stick”, so I will pontificate in my usual, windy, fashion here instead.
The Anglo-American tradition of “rule of law” is distinct from that of continental Europe or Confucianist traditions in A
sia, both of which are primarily concerned in different ways with the health of the state. Anglo-American “rule of law” has been an evolutionary – and sometimes revolutionary – march to constrain the exercise of arbitrary power and, eventually, assure an egalitarian access to justice. When Norman French-speaking King John of England bitterly complained at Runnymede that the English barons might as well demand his crown, he was right. The Magna Carta was intended to curb John’s capricious tyranny with formal rules governing how and when the King could exercise power against whom.
As national monarchies coalesced out of bastard feudalism’s kingdoms and medieval principalities in the fifteenth and sixteenth centuries, the Kings propagated a theory of divine right absolutism, which to our ears seems despotic, but to a sophisticated and wealthy, emerging, European bourgeoisie at that time, sounded like music. Better living under predictable, “national” laws and a King far away than a patchwork of greedy, grasping and unpredictable nobles who were ever close at hand. That same, rational, middle-class political sentiment though, soon found fault with even Enlightened absolutism.
Lord Chief Justice Sir Edward Coke, a great man to whom much is owed, but who today is largely forgotten, was the great theorist and defender of judicial independence and common law from the whims of a sovereign. Without judicial independence, the rule of law is hardly possible because it is ultimately inseparable from the executive power; Coke was instrumental in moving elite Englishmen’s minds from accepting “Rex lex” (“The King is Law”) to demanding “Lex rex” (“The Law is king”).
The matter was not formally settled with the English Civil War, which came not long after Coke’s death, or even the Glorious Revolution of 1688; nor the American Revolution of 1776 or even at Appomattox Courthouse. “The rule of law” is an ongoing struggle that must be constantly renewed by an active and vigilant citizenry if it is to be sustained.

The frequent and casual association of Chairman Mao with 4GW is something that has always puzzled me as well ( though, if memory serves, William Lind was always careful to explain that 4GW isn’t simply guerilla warfare). I think it can be attributed to the likelihood that most people who are somewhat familiar with 4GW theory tend to think first of guerillas and Mao is regarded as a great innovator there. However, is there merit in placing Mao in the “4GW pantheon” (if there is such a thing)?
In the ” yes” column I’d offer the following observations:
Mao, whose actual positive leadership contribution to Communist victory in the civil war was primarily political and strategic rather than operational and tactical ( his military command decisions were often the cause of disaster, retreat and defeat for Communist armies) had a perfect genius – I think that word would be an accurate description here – for operating at the mental and moral levels of warfare.
Partly this was skillful playing of a weak hand on Mao’s part; the Communists were not a match on the battlefield for the better Nationalist divisions until the last year or so of the long civil war but Mao regularly outclassed Chiang Kai-shek in propaganda and diplomacy – turning military defeats at Chiang’s hands into moral victories and portraying Communist inaction in the face of Japanese invasion as revolutionary heroism. Yenan might have be a weird, totalitarian, nightmare fiefdom but Mao made certain that foreign journalists, emissaries and intelligence liasons reported fairy tales to the rest of the world.
In the “maybe” column:
Regardless of one’s opinion of Mao ZeDong, China’s civil war, running from the collapse of the Q’ing dynasty in 1911 to the proclamation of the People’s Republic in 1949, is a historical laboratory for 4GW and COIN theory. The complexity of China in this era was akin to that of Lebanon’s worst years in the 1980’s but it lasted for decades. In a given province of China ( many of which were as large or larger than major European nations) then there might have been operating simultaneously: several warlord armies, Communist guerillas, Nationalist armies, the Green Gang syndicate, White Russian mercenaries, Mongol Bannermen, rival Kuomintang factions, common bandit groups and military forces of European states, Japan and the United States. Disorder and ever-shifting alliances and fighting was the norm and Mao was the ultimate victor in this era.
In the “no ” column:
Mao ZeDong, whatever his contributions to the art of guerilla warfare, intended, quite firmly, to build a strong state in China, albeit a Communist one in his own image. He was never interested in carving out a sphere of influence or an autonomous zone in China except as a stepping stone to final victory. Moreover, the Red Army’s lack of conventional fighting ability for most of the civil war related to a lack of means, not motive on Mao’s part. When material was available, particularly after 1945, when Stalin turned over equipment from the defeated Kwangtung army and began supplying a more generous amount of Soviet military aid to the Chinese Communists, Mao tried to shift to conventional warfare. When in power, he sent the PLA’s 5-6 crack divisions into the Korean War to face American troops in 2GW-style attrition warfare, not guerilla infiltrators behind MacArthur’s lines.
Finally, Mao’s personal political philosophy of governance, taken from Marxism-Leninism and Qin dynasty Legalism, are about as radically hierarchical and alien to 4GW thinking as it is possible to be.
In sum, Mao is and should be regarded as a major figure in the history of the 20th century and that century’s military history but he isn’t the grandfather of fourth generation warfare.

SOME NEUROCOGNITIVE IMPLICATIONS FOR NATION-BUILDING
Perhaps my favorite entirely apolitical blog is The Eide Neurolearning Blog run by the Drs. Brock and Fernette Eide, two physicians who specialize in brain research and its implications for educating children. With great regularity I find information there that either is of use to me professionally or has wider societal importance.
On Monday, the Eides posted “The Thinking Spot” which adds to the existing mountain of evidence regarding the role of the maturing prefrontal cortex in developing the capacity for higher order thinking that does not quite come to fruition until the early to mid-twenties but may begin as early as preadolescence. The Eides write, regarding the PDF studies cited:
“Rule-based learning has a developmental course (no big surprise), but what is a little surprising is the degree to which 12 year olds lag young adults in tests requiring them to make new rules.”
Consider that U.S. or Western intervention in Gap states, or alternatively, internal political reform movements like the ” Color Revolutions”, are essentially political efforts in forcing a ” Rule-set reset” on a dysfunctional society or failed state. If one prefers classic Lockean descriptors, rewriting the social contract to “create a more perfect union“.
Most, though not all, of the nations in which state failure threatens are also demographically undergoing a ” youth bulge”. In Iran for example, 66-70 % of the population is under 30 years of age with the “fattest” part of the population curve being aged between 10 and 20. Indeed, it is the poorest nations that tend to be the youngest. To quote a UN report:
“– Countries where fertility remains high and has declined only moderately will experience the slowest population ageing. By 2050, about 1 in 5 countries is still projected to have a median age under 30 years. The youngest populations
will be found in least developed countries, 11 of which are projected to have median ages at or below 23 years in 2050, including Angola, Burundi, Chad, Democratic Republic of the Congo, Equatorial Guinea, Guinea-Bissau, Liberia, Niger and Uganda.”
What I infer from this data and the Neurolearning Blog post is that the most favorable time for any effort, external or indigenous, to engage in a positive restructuring of a nation’s societal rule-sets may be when a given country’s youth bulge hits their early twenties. A narrow window of time when the most physically vigorous and largest section of the population has reached mental maturity in terms of accepting, comprehending and processing abstractions yet are most open to new ideas and desirous of a productive future for themselves.
This is of course a two edged sword. Youthful populations that feel alienated and stymied tend to be restive, even revolutionary. 1968 was not just a year that saw tumultuous baby boomers in American streets but also the chaos of Cultural Revolution in China, the Prague Spring, riots in Paris, the rise of Marxist terrorism in Latin America, Germany and Italy and barely preceded an upsurge in PLO terrorism. Today, while Europe and China are rapidly graying and the U.S. is holding relatively steady, much of the world is very young
I suggest that we are not long for an era of great opportunities and great upheavals.
